Flynn Whiplash

It has only been a matter of a few days since William Barr recommended dropping the charges against Lt. General Michael Flynn.  Attorney General AG Barr determined that the FBI “did not have a basis for a counterintelligence investigation against Flynn at that stage and that people sometimes plead to things that turn out not to be a crime.”  The recommendation however must be approved by the D.C. District Court Judge Emmet Sullivan for Flynn to be exonerated.  This is the same judge who presided over Flynn’s initial trial and appeared to show no mercy for Flynn at that time.  In fact at the first trial Judge Sullivan said in court, “I’m not hiding my disgust, my disdain for this criminal offense.”  The judge suggested that Flynn’s work with Turkey “undermined everything this flag over here stands for” and called Flynn a traitor.  Flynn was never charged with violating the Foreign Agents Registration Act in his dealings with the Turkish government.  This judge seems to be part of the anti-Trump Deep State and continues to hold a personal loathing for General Flynn.  Michael Flynn is a decorated soldier who served his nation honorably for over 30 years.  I seriously doubt that anyone who knows him and has served with him would regard Flynn as a traitor.  The fact that Judge Sullivan blocked any “friend of the court” submissions supporting the outstanding character and patriotism  of this man was a true injustice.  Now in his review of the Flynn case,  Sullivan will now permit friend of the court submissions against Flynn.  Judge Sullivan did not wish to hear from third parties when he knew they would have spoken favorably of Flynn.  Yet he is openly soliciting briefs when he assumes they will be critical of Flynn.  In a display of judicial malfeasance this judge is not living up to his oath of impartiality and equal justice under the law.  Traditionally circuit court judges have not gone against the government’s decision not to prosecute a defendant.  Once again this judge is making a personal exception and is unwilling to accept Barr’s advice in this case.  In the meantime a Left-wing group known as the Watergate Prosecutors have already submitted a brief attacking Flynn and the dropping of charges by the DOJ. Instead of accepting responsibility for the outcome the judge appears to be allowing liberal groups to make the decision for him.

Much of the FBI’s investigation of Flynn was initiated over a phone call the incoming National Security Advisor had with Russia’s then-Ambassador Sergey Kislyak.  The FBI acknowledged at the time this call was not improper or criminal.  It was later used as part of their investigation in an effort to either incriminate or at least get Flynn fired.  Obama who was not a fan of General Flynn was aware of the phone call and may very well have ordered the FBI to initiate their investigation.  Obama warned President-elect Trump against relying on Flynn’s advice.  Obama fired Flynn in 2014 from his position as head of the Defense Intelligence Agency.  Obama blamed the firing on insubordination but Flynn believed he was pushed out for his aggressive stance on combating lslamic extremism.  The FBI (under Comey’s direction) interviewed Flynn in the White House without the benefit of a lawyer present and tricked him into a perjury trap.  Flynn ultimately pleaded guilty in late 2017 of lying to the FBI chiefly to relieve himself (and his family) of increasing legal fees and threats to investigate his family.  It is disheartening to see how mistreated a decorated warrior has been treated by the country to which he has given so much.
